Terms of Service

These terms of service apply to all accounts, purchases, subscriptions, renewals, cancellations, and use of the Maxx Force Hockey training platform.
1. Who you are contracting with
These Terms & Conditions ("Terms") form an agreement between you and Maxx Force Hockey ("Maxx Force Hockey", "we", "us"), the operator of the Shift IQ Hockey / Game Sense training platform (the "Service"). By creating an account or using the Service, you agree to these Terms.
2. The Service
The Service is an interactive web platform that helps hockey players improve their on-ice decision making through scenario-based training, animated rink replays, an IQ score, streaks, and levels. We may add, modify, or remove features over time.
3. Eligibility and accounts
You must be of legal age in your jurisdiction (or have a parent/guardian's permission) to use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.
4. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or abusive purpose;
- infringe anyone's intellectual property or privacy rights;
- upload malware, attempt to probe or breach our security, or scrape the Service;
- resell, redistribute, or share access to your account;
- reverse engineer or circumvent any technical limits of the Service.
5. Intellectual property
The Service, including all software, content, animations, scenarios, branding, and documentation, is owned by Maxx Force Hockey and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have purchased. All other rights are reserved.
6. Payment, subscriptions, renewals and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns. Payment terms, billing frequency, taxes, cancellations, and renewals are governed by Paddle's Buyer Terms. Subscriptions renew automatically each billing period until cancelled. You can manage or cancel your subscription from your account page or via the Paddle customer portal.
7. Refunds
Refunds are handled in accordance with our Refund Policy.
8. Service availability
We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies. You may cancel your subscription at any time; access continues until the end of the current paid period.
10. Liability
To the maximum extent permitted by law, our aggregate liability to you under or in connection with the Service is limited to the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the jurisdiction where Maxx Force Hockey is established, without regard to its conflict of laws rules.
